Welcome to Stott and May’s website. These Website Terms of Use (“Terms”) govern your access to and use of Stott and May’s website, including any content, functionality, and services offered through it. By accessing or using our site, you acknowledge that you have read and understood these Terms and agree to be bound by them.
If you do not agree with any part of these Terms, please do not use the website. We also encourage you to review our Privacy Policy, which explains how we collect and handle your personal data.
Separate commercial terms for introductions
If you are a client receiving candidate introductions from Stott and May (whether through our consultants or via email), please note that such introductions are governed by separate terms of business. These terms are provided or linked in our email communications or agreed separately in writing. These Website Terms of Use apply in addition to, and do not override, any such commercial terms.

Website use and conduct
Permitted Use: We grant you a limited, non-exclusive, non-transferable license to access and use this website for its intended purposes – such as searching for job opportunities as a candidate, or posting jobs/engaging with candidates as an employer/client – and for your own personal or internal business use. All usage must be lawful and in accordance with these Terms. "Intended purposes" include, but are not limited to, using the site for job searching, candidate sourcing, and communication related to recruitment activities. Legal age requirements will be determined by the jurisdiction of the user. This site is intended to be accessed from many devices, and these terms apply to all access methods.
Prohibited Activities:
You agree NOT to use the website in any way that violates any law or these Terms, or that harms Stott and May or any other party. Prohibited uses include (but are not limited to) the following:
- False or Misleading Information: Do not post inaccurate, incomplete, or false information on the site. For example, candidates must not provide false biographical details or misrepresent their legal right to work. Similarly, employers/clients must only post truthful and current job information and have the right to offer any jobs listed.
- Offensive or Unlawful Content: Do not transmit any content that is defamatory, obscene, harassing, threatening, or otherwise objectionable or unlawful. This includes material that is vulgar, abusive, hateful, discriminatory, or that could infringe someone’s rights or privacy.
- Unauthorized Use of Materials: Do not upload or share any material that you don’t have permission to use. This includes proprietary content of others (protected by copyright, trade secret, etc.) without permission. You also must not post content that infringes any third-party intellectual property rights.
- Malicious Technical Acts: Do not introduce viruses, malware, or any other harmful code to the site. You must not attempt to hack, disrupt, overburden, or impair the website – for example, by launching denial-of-service attacks, “spamming” the site with repetitive information, or using any device or software to crash or slow it down. Automated data collection (e.g., bots or scrapers) is strictly prohibited without our prior written consent. This includes any attempt to circumvent any measures used to prevent scraping.
- Abusive Behaviour: Do not use the site to harass, bully, or defame any individual or company, including Stott and May or other users. Any conduct that could damage our reputation or the dignity and rights of others is forbidden.
- Unintended Purposes: Use the site only for its intended recruitment-related purposes. You must not use the site to advertise unrelated services, solicit business unrelated to Stott and May’s services, or engage in any commercial activity not expressly permitted. You must not mirror, frame, or link to our site in a way that misrepresents your relationship with us or implies an endorsement without our prior written approval. Stott and May may suspend or terminate your access at any time if you violate these rules, and we reserve the right to report any illegal activities to law enforcement.

User registration and obligations
Account Creation: Some features (such as creating a candidate profile, applying for jobs, or a client posting a vacancy) may require you to register an account. When you create an account, you must provide accurate and complete information about yourself or your business, as applicable, and keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
Do not share your username or password with others, and notify us immediately if you suspect any unauthorized use of your account or a security breach. Stott and May is not liable for any loss or damage arising from someone else using your account due to your failure to keep your credentials secure. Stott and May reserves the right to terminate accounts that have been inactive for a long period of time. Stott and May may verify user information.
Candidate Responsibilities: If you register as a candidate seeking opportunities, you agree to use the site honestly and responsibly in your job search. This means you will provide truthful, current information about your qualifications, work experience, and legal work status.
You should only apply to roles for which you are qualified and genuinely interested. When you submit your résumé/CV or other application materials, you confirm that you have the right to do so and that these materials are accurate and not misleading or confidential to a third party.
You retain ownership of the content you provide, but by submitting it, you grant Stott and May a license to use, store, and process that information for recruitment purposes in line with our Privacy Policy. This allows us, for example, to share your application with prospective employers/clients and to contact you about relevant opportunities. (For clarity, we never charge candidates any fees to use the website or our services – our recruitment services are free for job-seekers.)
Employer/Client Responsibilities: If you are using the site as an employer or other business contact (for instance, to post job openings, to search our candidate database, or to otherwise engage our recruitment services), you agree to use the site only for legitimate hiring and business purposes. Any job postings or inquiries must be bona fide and legal opportunities with the intent to hire. You represent and warrant that you are authorized to act on behalf of your company or client in using the site, and that any information you provide about a job opening or a candidate is accurate and lawful. You further agree to treat any candidate information obtained through our site or services as confidential and to use it solely for recruitment evaluation purposes, in compliance with applicable data protection laws. No unauthorized use or re-disclosure of candidate data is permitted without the candidate’s and Stott and May’s consent. Employers agree to provide equal opportunities and not discriminate when job postings.
No Improper Use of the Services: All users (candidates, clients, or others) agree not to misuse any interactive features or integrations on the site. For example, if our site integrates with third-party systems (such as a CRM or application tracking system) to process job applications, you must not attempt to bypass or interfere with those systems. Submitting applications or data via automated scripts, or other than through our intended interface, is not allowed. You are responsible for the content you upload or submit (“User Content”), and you must ensure it does not contain harmful code, violate any law, or infringe anyone’s rights.
We may remove or modify any User Content that violates these Terms or that we find objectionable, without notice to you. If Stott and May facilitates background checks, this will be stated, and the user must consent to it. User data will be retained in accordance with our Privacy Policy.
Text Message Communications: By providing your mobile phone number and affirmatively opting in, you consent to receive text messages from Stott and May for recruitment-related purposes, including job alerts, application updates, and scheduling. Message frequency varies. Message and data rates may apply. To opt-out of receiving these messages, reply STOP to any message received. For assistance, reply HELP. Your consent to receive text messages is not a condition of using our services or applying for any position. Stott and May and mobile carriers are not liable for delayed or undelivered messages. We reserve the right to terminate the text service, in whole or in part, at any time without notice. Your use of the text service is also subject to our Privacy Policy.

Intellectual property rights
Ownership of Website Content: All content on the Stott and May website – including text, graphics, logos, button icons, images, videos, data compilations, software, and overall design – is the property of Stott and May or its licensors and is protected by copyright, trademark, and other intellectual property laws. Stott and May and its logos and brand names are trademarks of Stott and May. You are not granted any right or license to use our name or logos except as necessary for legitimate reference to our services. All third-party trademarks or logos appearing on the site (for example, client or partner logos) are the property of their respective owners and are used on the site with permission; you have no rights to use those marks.
Third-party content, features, or tools (such as widgets, applicant tracking integrations, or embedded media) may be subject to separate terms from those providers. Stott and May is not responsible for the content or performance of such third-party features.
Permitted Use of Content: You may access, download, and print materials from the website for your personal use or your company’s internal use in connection with our services (such as evaluating job opportunities or candidates).
Any copies of the site content must maintain all copyright and proprietary notices in the same form as on the original. No other use of the site content is permitted without our prior written consent. In particular, except as explicitly allowed by these Terms, you must not: (a) copy, reproduce, modify, distribute, or publicly display any portion of the site; (b) create derivative works from any part of the site; (c) use any content for commercial purposes unrelated to Stott and May’s services; or (d) reverse-engineer, decompile, or attempt to extract the source code of any software on the site. Additionally, no “scraping”, data-mining, or automated extraction of content is permitted.
User Content and Feedback: As noted, you retain ownership of any resume, profile information, postings, or other content you submit to the site (User Content). However, by submitting User Content, you give Stott and May a worldwide, royalty-free, perpetual right to use, reproduce, adapt, modify, publish, translate, and distribute such content for the purpose of providing and promoting our recruitment services.
For example, we may share your CV with a potential employer or use a testimonial you provide about our services. This is subject to our Privacy Policy – we will handle User Content in accordance with our Privacy Policy and applicable law. You also agree that any suggestions or feedback you provide to us regarding the website or our services may be used by us freely and without compensation to you. User content can be removed without warning. If applicable, Stott and May will adhere to the Digital Millennium Copyright Act (DMCA).

Disclaimers
No Guarantee of Job Placement, Engagement, or Service Outcome: Stott and May provides recruitment, consulting, and talent solutions, including contractor services, project delivery, training, and other related services, but we do not guarantee any specific outcomes from using this site or engaging with our services. For candidates, using our website or applying to jobs through us does not ensure that any organisation will review your information, invite you for an interview, or offer you an engagement. Engagement decisions are made by the employers/clients, not by Stott and May, and therefore we make no promises that you will obtain an engagement. For clients, we do not guarantee that a suitable candidate, contractor or service provider will be found for your requirement, or that anyone we present will accept an offer or remain in any engagement for any minimum duration. We also do not guarantee the success or particular results of any consulting or project-based service. Any arrangements made between a candidate, contractor or service provider and an employer/client to whom they are introduced through our site (or through our services more broadly) are solely at the risk of those parties.
Where candidates, contractors, or service providers are introduced to an employer or client via our website, such introductions are facilitated by Stott and May and may give rise to a fee or other commercial entitlement under our terms of business. We are not responsible for any disputes, performance issues, or losses arising from those relationships. For clarity, any candidate introductions made outside of the website (e.g., by email) may be governed by our separate terms of business, which prevail in the event of any conflict with these Website Terms of Use.
Website Information “As Is”: While we strive to present accurate, up-to-date information on our site (e.g., job descriptions, articles, salary surveys, and other resources), we make no warranties or representations about the accuracy or completeness of the website’s content. Information on the site is provided in good faith, but it may occasionally be out of date, contain errors, or be incomplete. Use of the site is at your own risk. We provide the website and its contents on an “as is” and “as available” basis, without any warranty of any kind – either express or implied – including but not limited to the implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement. We may withdraw or change site content or features at our discretion and without notice (though we will try to provide notice of major changes when feasible).

Limitation of liability
No Indirect Damages: To the fullest extent permitted by applicable law, Stott and May and our affiliates will not be liable for any indirect, consequential, special, or incidental losses or damages arising out of or in connection with your use of (or inability to use) this website. This exclusion includes any loss of profit, loss of business, loss of opportunity, loss of data, or loss of goodwill, even if we have been advised of the possibility of such damages. Cap on Direct Liability: To the extent permitted by law, Stott and May’s total liability (including that of its directors, officers, employees, and agents) arising from these Terms or your use of the website will not exceed the amount you paid to use the website or our services (if any), or, if no such payment was made, a reasonable amount considering the nature of the service and the user's interaction with the site. Release and Indemnity: You agree that if you have a dispute or issue with any third party (e.g. an employer, candidate, other service provider, or organisation arising from your use of our site, you release Stott and May from any claims, demands, and damages arising out of or in connection with such dispute. Additionally, you agree to indemnify and hold Stott and May (and its affiliates and personnel) harmless from any claim or demand (including reasonable legal fees) made by any third party due to or arising out of your breach of these Terms, your misuse of the website, or your violation of any law or the rights of a third party. This means that if a third party (for example, an intellectual property owner or another user) brings a claim against us because of something you posted or did on the site, you will reimburse us for our costs and losses to the extent that claim arises from your misconduct or violation of these Terms.

Governing law
Stott and May operates globally, and for legal purposes we have different corporate entities in different regions. These Terms are intended to apply to users worldwide, but the governing law and jurisdiction for disputes may depend on where you are using our services:
- If you are using our website from the United Kingdom or elsewhere in Europe: These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) are governed by the laws of England and Wales. You and Stott and May agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising from or relating to your use of the website. (If you are a consumer in the EU, you may also have rights to pursue claims in your home country under local consumer protection laws; these Terms do not limit any such rights that cannot be waived.) Any dispute resolution process will be in accordance with the laws of England and Wales.
- If you are using our website from the United States: These Terms and any disputes arising from your use of the site will be governed by the laws of the State of New York, USA, and applicable U.S. federal law, without regard to conflict of law principles. The courts of New York County in the State of New York shall have non-exclusive jurisdiction over any such dispute. Notwithstanding the foregoing, Stott and May reserves the right, at its sole discretion, to initiate proceedings in the courts of the jurisdiction in which you are incorporated, established, or primarily conduct business, particularly for the purpose of enforcing legal rights or payment obligations. Nothing in this clause limits Stott and May’s right to seek equitable relief or to assert common-law indemnification or contribution claims where applicable.
- If you access the site from another jurisdiction: We make no representation that the website content or services are appropriate or available for use in all locations. Users who choose to access the site from outside the UK, EU, or USA do so on their own initiative and are responsible for compliance with local laws. You agree that any claims will be resolved under one of the governing laws listed above, depending on the Stott and May entity you interact with.
Please note that nothing in this section will limit the applicability of any mandatory laws (such as consumer protection or data protection laws) that apply to you in your country of residence, to the extent those laws by their terms cannot be waived or chosen away.

Enforcement and termination
Suspension or Termination by Stott and May:
We reserve the right to suspend, restrict, or terminate your access to the website (or certain features of it) at any time if we believe you have violated these Terms or abused the site. Such suspension/termination may occur with or without notice, and with immediate effect. For example, if we determine that a user has posted prohibited content or engaged in fraudulent activity, we may disable their account and remove any offending material. We also reserve the right to terminate the website or any portion of it, or discontinue any feature or service, at any time for business or technical reasons, without prior notice. You acknowledge that Stott and May will not be liable for any loss or damage caused by such suspension or discontinuation.
User Termination:
You are free to stop using our website at any time. If you wish to delete your account or withdraw from our services, you may do so through the account settings or by contacting us. Termination of your account will not affect any rights or obligations that have accrued before the date of termination. Upon termination of an account, user data will be handled in accordance with our Privacy Policy.
Survival of Terms:
Any provisions of these Terms that by their nature should survive termination of your access will survive (for example, the sections on Intellectual property rights, Disclaimers, Limitation of liability, Governing law, Dispute resolution, and this section on Enforcement and termination).

Dispute resolution
Informal Resolution:
We encourage you to contact us first if you have any issue or dispute regarding the website or our services. Often, concerns can be resolved quickly through our customer service team.
Arbitration (if applicable):
In some cases and in some jurisdictions, we may offer or require arbitration to resolve disputes. If you have signed a separate arbitration agreement with us, that agreement will apply. Otherwise, any unresolved disputes will be subject to the courts outlined in Section 6.
Litigation:

Notwithstanding the above, either party may seek injunctive or equitable relief in a court of competent jurisdiction to prevent actual or threatened misuse of its intellectual property, confidential information, or other proprietary rights.

Our separate Privacy Policy describes in detail how we collect, use, store, and protect your personal information when you use our site or services. The Privacy Policy is incorporated into these Terms by reference.
